Your privacy is important to Associated Medical Services Inc. (“AMS”). This Privacy Policy explains how AMS collects, uses, discloses, retains and deletes your personal information, including information collected through AMS’ website www.ams-inc.on.ca. AMS does not collect any personal information except as set out below or you specifically provide it to us.In this Privacy Policy, “personal information” means information about an identifiable individual.1. Your Consent

By providing AMS with your personal information, you consent to the collection, use, disclosure, retention and deletion of that information in accordance with this Privacy Policy and as otherwise permitted by applicable law.

If you are under the age of majority in the jurisdiction in which you live, then your parent or legal guardian must register a AMS account on your behalf, and by doing so your parent or guardian consents and confirms that you consent to the collection, use, disclosure, retention and deletion of your personal information in accordance with this Privacy Policy and as otherwise permitted by applicable law.

If you breach any provision of this Privacy Policy, or are no longer using AMS’ website for the purposes permitted in this Privacy Policy, you may no longer use AMS’ website. AMS may, at any time and for any reason and in its sole discretion, change, suspend or terminate, temporarily or permanently, AMS’ website or any part of it, or your permission to use AMS’ website, without any prior notice or liability to you or any other person. If this Privacy Policy or your permission to use the Website is terminated by you or AMS for any reason, then this Privacy Policy will continue to apply and be binding upon you in respect of your prior use of AMS’ website.

2.  How AMS Collects Personal Information

(a) Direct Collection
You may voluntarily provide your personal information to AMS, including when you subscribe to AMS’ mailing list. In those circumstances, you can choose not to provide certain requested personal information, but then you may not be able to access or use certain features offered by AMS.

(b) Websites, Cookies and Other Technologies
AMS’ website may automatically collect certain non-personal information regarding your use of the website, such as the dates and times you access the website, the browsers, operating systems and devices you use to access the website, the website pages you access, and the referring and exit website pages. AMS may use that non-personal information for various purposes, including to administer and improve the website and AMS’ services.

AMS’ website may also use “cookies” and other similar technologies, such as web beacons, pixel or gif tags, and action tags. Those technologies collect information that assist AMS to improve its services and to provide communications to you. AMS may use information collected through cookies and similar technologies to recognize you as a user of AMS’ website, track your use of the website, offer personalized web page content and information, and otherwise facilitate and improve your website experience. AMS may use web beacons, pixel or gif tags, and action tags to confirm that email messages have been delivered to and opened by you.

AMS treats information collected by cookies and similar technologies as non-personal information, except that if internet protocol (IP) addresses or other similar identifiers are considered personal information under your local laws then AMS will treat that information as personal information for the purposes of this Privacy Policy.

You may choose to decline or disable cookies if your web browser permits, but doing so may affect your ability to access or use certain features of AMS’ websites.

3. How AMS Uses Personal Information

AMS uses your personal information for various purposes, including to correspond and provide you with communications, services and information regarding AMS and to develop, deliver, and improve AMS’ services.

4.   How AMS Discloses Personal Information

(a)  Affiliates
AMS and its affiliates may share your personal information with each other and may use, disclose, transfer and retain your personal information in accordance with this Privacy Policy.

(b) Legal Disclosures
AMS may disclose personal information about you in order to:  (1) protect the legal rights, interests, remedies privacy, safety, property, business or operations of AMS or its employees, agents, contractors or the public; (2) protect the safety and security of visitors to our website or other properties; (3) protect against fraud or other illegal activity or for risk management purposes; (4) respond to inquiries or requests from legal authorities; (5) respond to an emergency; (6) comply with the law or legal process; (8) or as otherwise required under all applicable legislation.
AMS has no control over, or responsibility or liability for, the use, disclosure, retention and deletion of your personal information by the agencies, organizations or other persons to whom AMS discloses the information in the foregoing circumstances, and the use, disclosure, retention and deletion of the disclosed information by those agencies, organizations or other persons is not subject to this Privacy Policy.

(c)  Service Providers
As applicable, AMS may disclose your personal information to AMS’ service providers to assist AMS in the provision of services to you, to provide products and services to AMS, to assist AMS to use your personal information in accordance with this Privacy Policy and as otherwise permitted by applicable law. AMS requires its service providers to agree to use your personal information only for the purposes for which it is provided to them, and to protect the privacy of your personal information in a manner that is consistent with this Privacy Policy.
In the event AMS transfers or intends to transfer personal information to a service provider outside of Canada, AMS will provide notification at the time of collection of personal information or when the information is transferred. Where personal information is located outside of Canada, it is subject to the laws of that jurisdiction.

5.  Retention, Location and Protection of Personal Information

AMS retains your personal information for the period reasonably necessary for the purposes set forth or referenced in this Privacy Policy or a longer retention period required or permitted by applicable law.

AMS employs reasonable safeguards, including administrative, physical and technical security and safeguarding measures and solutions, appropriate to the sensitivity of the personal information in AMS’ possession or under AMS’ control in order to protect the information from unauthorized access, collection, use, disclosure, disposal or similar risks.

6. Deletion of Personal Information

AMS will delete or dispose of your personal information when AMS is no longer reasonably required to retain the information for the purposes set forth or referenced in this Privacy Policy.

7.  Accuracy and Access to Personal Information

AMS will rely on you to ensure that your personal information is as accurate, complete and up to date as necessary for the purposes of the products and services that AMS provides to you. You will promptly notify AMS of any changes to your personal information by using the contact information noted below.

You may request access to your personal information and information about AMS’ collection, use, disclosure, retention and deletion of your personal information by submitting a written request to AMS using the contact information noted below. Subject to applicable exceptions and limitations prescribed by applicable law, you will be given reasonable access to your personal information within a reasonable time and you will be entitled to challenge the accuracy and completeness of your personal information and to have it amended as appropriate.

8.  Non-Personal Information

AMS may create, collect or use personal information to create non-personal information (information that is not about an identifiable individual), and AMS may then use, disclose, transfer and retain the non-personal information for any purpose and in any manner whatsoever.

If non-personal information is combined with personal information, then the non-personal information will be treated as personal information for the purposes of this Privacy Policy.

9.  Governing Law

This Agreement shall be governed solely by the laws of the Province of Ontario, Canada and applicable federal laws of Canada. Any dispute between AMS and you or any other person arising from, connected with or relating to the Website, this Agreement or any related matters must be resolved before the Courts of the Province of Ontario sitting in the City of Toronto.

10.  Other Matters

(a) Business Contact Information:  To the extent permitted by applicable law, the provisions of this Privacy Policy concerning personal information do not apply to information (such as your name, position or title, business address, business telephone number, business fax number and business email address) that enables you to be contacted at a place of business.

(b) Users under 18 years of age:  AMS does not knowingly collect personal information from or relating to users who are under 18 years of age without the consent of the users’ parent or legal guardian. AMS expects parents to supervise and monitor their children’s disclosure of personal information. Please immediately contact AMS using the contact information noted below if you believe that AMS has unintentionally collected personal information from a user under 18 years of age without the consent of the user’s parent or legal guardian. If AMS learns that it has inadvertently collected the personal information of a user under 18 years of age without appropriate consent, AMS will use reasonable efforts to delete that information from its systems (except to the extent that retention of the personal information is required or permitted by applicable law).

(c) Other Websites/Online Services:  AMS’ websites may contain links to other websites or online services. When you use those links you are contacting another website or service. AMS has no responsibility or liability for, or control over, those other websites or service or their collection, use, disclosure, retention and deletion of your personal information. Please refer to the privacy policies and terms of use that apply to those other websites or online services.

(d) Unsubscribing to Messages:  You may unsubscribe from AMS’ commercial electronic messages by using the applicable self-service unsubscribe procedure (for example, by clicking an unsubscribe link in an email) or by contacting AMS using the contact information noted below.

(f)  English Language:  You and AMS have each expressly requested and required that this Privacy Policy and all other related documents be drawn up in the English language. (g) Changes to this Policy:  AMS may change this Privacy Policy from time to time by posting a new version of this Privacy Policy on AMS’ websites. AMS’ collection, use, disclosure, retention and deletion of your personal information will be governed by the version of this Privacy Policy in effect at that time. Your continued dealings with AMS subsequent to any changes to this Privacy Policy will signify your consent to the collection, use, disclosure, retention and deletion of your personal information in accordance with the changed Privacy Policy. Accordingly, you should check the “Last Revised” date of this Privacy Policy (at the top of this Policy) and review any changes since the last version.
